1. Introduction

 

Welcome to Yembeni Bush Lodge (“Yembeni”, “the Lodge”, “we”, “us”, “our”).

 

These Terms and Conditions govern your use of our website and your stay at Yembeni Bush Lodge. By accessing our website, making a booking, or staying at the Lodge, you agree to be bound by these Terms.

 

If you do not agree to these Terms, please do not use our website or proceed with a booking.

2. Booking & Confirmation

  • All bookings are subject to availability.

  • A booking is only confirmed once written confirmation has been issued and full payment has been received.

  • The person making the booking warrants that they are authorised to accept these Terms on behalf of all guests in the booking party.

  • Guests must be 18 years or older to make a booking.

3. Rates & Payment

  • All rates are quoted in South African Rand (ZAR).

  • 50% of the total booking amount is payable on the day of booking in order to secure the reservation.

  • No booking will be held without full payment.

  • Failure to make immediate payment may result in the release of the booking.

  • We reserve the right to correct pricing errors before confirmation.

4. Cancellation & Refund Policy (CPA Aligned)

 

In accordance with the Consumer Protection Act:

  • Cancellations more than 30 days before arrival: Full refund minus a reasonable administrative fee.

  • Cancellations 14–30 days before arrival: 50% of total booking forfeited.

  • Cancellations less than 14 days before arrival: 100% of booking forfeited.

  • No-shows or early departures are non-refundable.

 

Refunds will be processed via the original method of payment within a reasonable timeframe.

 

Yembeni Bush Lodge reserves the right to retain reasonable cancellation penalties to cover losses suffered.

5. Check-In & Check-Out

  • Check-in: From 14:00

  • Check-out: By 11:00

 

Early check-in or late check-out may be permitted by prior arrangement and may incur additional charges.

 

Valid identification may be required upon check-in.

6. Occupancy & Conduct

  • Maximum occupancy: 6 guests.

  • No additional guests are permitted on the property without prior written approval.

  • No parties or events are permitted unless pre-approved.

  • Guests must behave responsibly and respectfully at all times.

  • Excessive noise, illegal activity, or behaviour that disturbs neighbours, staff, or wildlife may result in immediate termination of the stay without refund.

7. Damage & Breakages

 

The lead guest accepts responsibility for any damage, loss, or breakages caused during the stay.

 

We reserve the right to invoice the responsible guest for repair or replacement costs if necessary.

8. Wildlife & Assumption of Risk

 

Yembeni Bush Lodge is located in a natural bush and game reserve environment.

 

By staying at the Lodge, guests acknowledge that:

  • Wildlife may roam freely within the reserve.

  • Insects, reptiles, and wild animals may be present.

  • Outdoor and guided activities carry inherent risks.

 

Guests voluntarily assume all risks associated with staying in a wildlife environment.

 

Children must be supervised at all times.

 

Yembeni Bush Lodge shall not be held liable for injury, loss, or damage arising from interaction with wildlife or participation in outdoor activities, except in cases of gross negligence.

9. Guided Activities & Third-Party Services

 

Where additional activities are offered:

  • Participation is voluntary.

  • Additional indemnity forms may be required.

  • Yembeni may act as an agent for third-party operators.

  • We are not liable for the acts or omissions of third-party service providers.

10. Utilities & Force Majeure

 

We are not liable for interruptions beyond our control, including:

  • Load shedding

  • Water shortages

  • Extreme weather

  • Natural disasters

  • Government restrictions

  • Civil unrest

 

We will take reasonable steps to minimise inconvenience.

11. Website Use

 

All website content is the property of Yembeni Bush Lodge and may not be copied or distributed without written permission.

 

We do not guarantee uninterrupted or error-free access to the website.

12. Privacy & POPIA Compliance

 

Personal information is collected and processed in accordance with the Protection of Personal Information Act (POPIA).

 

By making a booking, guests consent to:

  • The collection of necessary personal details

  • Secure storage of such information

  • Processing of payments via secure third-party providers

 

We do not sell or distribute personal information except where required by law or necessary to provide services.

13. Limitation of Liability

 

To the maximum extent permitted by South African law:

  • Yembeni Bush Lodge shall not be liable for indirect or consequential loss.

  • Liability shall not exceed the total value of the booking paid.

 

Nothing in these Terms excludes liability for gross negligence where such exclusion is not permitted by law.

14. Governing Law

 

These Terms are governed by the laws of the Republic of South Africa.

 

Any disputes shall fall under the jurisdiction of South African courts.

15. Amendments

 

Yembeni Bush Lodge reserves the right to amend these Terms at any time. Updated Terms will be published on our website and apply from the date of publication.
